When we (Ian Brotherton Mountain Leader) have received your booking we will issue you with a booking acceptance confirmation containing full details of your event by e-mail. This acceptance confirmation forms the contract between us and will come into effect from the date on the communication to you, subject to the Terms & Conditions below.

Please read the following statements carefully.

A place on an activity is only confirmed once a deposit or the Total Payment has been received, unless confirmed otherwise beforehand.

If a client cancels

  • If a client decides to cancel we need written confirmation of the cancellation. If you cancel your place within 4 weeks of the activity starting please note that we will not refund your payment if we are unable to fill your place.

  • We recommend that you take out insurance to cover any cancellation costs including accommodation and transport costs as Ian Brotherton Mountain Leader is not liable for these costs and is unable to reimburse any extra costs.

If we cancel

  • Sometimes, regrettably, Ian Brotherton Mountain Leader may have to cancel an activity due to unsuitable weather conditions, or other unforeseeable reason. If this is the case we will refund the payment in full or have the option of a place on another activity.

  • Ian Brotherton Mountain Leader is not liable however for any accommodation or transport costs and we strongly recommend that you take out insurance to cover these.

Safety Statement

  • BMC Participation Statement: The BMC recognises that climbing and mountaineering are activities with a danger of personal injury or death. Participants in these activities should be aware of and accept these risks and be responsible for their own actions. 

  • By booking an activity you are aware and accept these risks and will be responsible for your own actions and involvement. You also accept that you must abide by any safety decisions taken by the walk leader/instructor. This may mean changing plans for the day and doing a different walk to that you booked onto. Mountaineering, hill-walking and climbing are all hazardous activities. There is always an element of risk which could result in injury or death.

  • Ian Brotherton Mountain Leader accepts no responsibility for accidents or injuries or for loss or damage of personal effects.

Insurance

  • Ian Brotherton Mountain Leader has full public liability insurance cover. We advise you to take out your own cover such as that offered by the BMC. We also recommend that you take out insurance that covers cancellation.

  • Participants are not insured by Ian Brotherton Mountain Leader against personal accidents and so we recommend you take out your own personal accident insurance.

Fitness & Environment

  • Mountain Walking, scrambling and hill walking are physically demanding activities. You need to ensure that you are fit enough to participate in the activities or courses that you have booked into for your own enjoyment and that of other clients. Hill and mountain walks, require a good level of fitness and stamina. Navigation courses do require some previous hill-walking experience but they tend to be less distance with lots of stops to discuss techniques and practice skills.

  • The Walk Leader/instructor reserves the right to refuse to take a participant whom they consider will be unable to complete the planned activity, is wearing unsuitable clothing, ignores direct safety instructions from the Walk Leader or whose behaviour puts others within the group at risk.

Weather

  • We may encounter poor conditions such as strong winds, rain, mist, fog and hot or cold temperatures.

  • Ian Brotherton Mountain Leader staff will continuously monitor weather and ground conditions during an activity and adjust the plan for the day to suit the conditions. This may mean changing the planned route for the day and/or may mean a different walk altogether.

  • The decision to change (or end) an activity lies solely with the Walk Leader/Instructor.

Other

  • Alcohol & smoking are not permitted during the activity.

  • Dogs – Most courses/walks are not suitable for dogs, due to ground nesting birds, livestock, terrain etc. You must have permission from Ian Brotherton Mountain Leader before the course/walk in order to bring your dog with you. Registered assistance dogs are always welcome.

  • Under 18s may attend if accompanied by a parent or legal guardian. Minimum age is 14.

Data Protection

  • The personal information requested by the Company at the time of booking plus any subsequent information is held in on paper and digitally. The information is required to assist the company, employees and sub-contractors to deliver the course and in maintaining the company’s high standards of delivery. By providing us with the information to process your booking you are agreeing that the information can be kept and accessed by authorised company personnel.

  • Contact details will be used to advise you of future offers by post, email, SMS or phone ONLY if you have given us your permission to do so. If you do not want us to use your data to send you our e-news and/or other marketing materials via email and/or post, please check or uncheck the relevant box(es) situated on the booking form on which we collect your data. You can also exercise your right to opt out of receiving such e-news and/or marketing materials at any time by contacting us by email at ianbrotherton@hotmail.com. Please note certain details will be required to be kept for insurance purposes for seven years.
